Declaration of Surviving Soldiers For Pension State of Tennessee, Giles County.

Braxton ONeal
October 2, 1871

On this 2nd day of October A.D. one thousand eight hundred and seventy one, personally appeared before me (Hans A. Wynett?) clerk of the county Court a court of record within and for the County and State afore said, Braxton ONeal aged 75 years, declares that he is a widow unmarried, that his wife was Polly Clarke to whom he was married at Lawrence Co. Alabama on the 1st day of December 1811; that he served the full period of sixty days in the Military services  of the United States in the War of 1812; that he is the identical Braxton ONeal who was taken in Captain Walter's company. Col. Medcalf's Regiment, Gen. Wm. Carrol Brigade, Gen A. Jackson's Division at Fayetteville in the State of Tennessee on -- Day of October, 1814, and was honorably discharged at Fayetteville on the -- day of March or April 1815; that he was at the Battle of New Orleans.  Has received 2 land warrants under act of Sept. 1850 & March 1855 for said services, but can't state their numbers.  That he had been able to sign his name, but now by cause of old age, makes his marks.  That at no time during the late rebellion against the authority of the United States, adhered to the cause of the enemies of the Government, giving them aid and comfort, or exercised the functions of any office whatever under any authority or pretended authority in hostility to the United States; and that he will support the United States; that he is not in receipt of a pension under any previous act; this being first legal application.  That he makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the Act of February 14, 1871; and he hereby constitutes and appoints with full power of substitution and revocation, Nathan Adams, Pulaski, Tenn., his true and lawful Attorney, to prosecute his claim and obtain the pension certificate that may be issued; that his post office is at Pulaski, County of Giles, State of Tennessee, and that his domicile or place of abode is said Civil District. Giles County Tennessee - Deed of Trust John Thornton & B. Oneal Deed of Trust to Benjamin P. Higgins (Note: a lot of the document is very bad and cannot be read)  We John Thornton & Braxton Oneal have this day sold & do herby convey to Benjamin P. Higgins for the sum of five dollars to me paid in hand and consideration herein after mentioned our present growing cotton crop containing thirty acres in Giles County Tennessee District No. 1  To have and to hold the same to the said Benjamin P. Higgins, his heirs and assigns forever;  We do covenant with the said Benjamin P. Higgins that we are lawfully seized of said cotton crop.  Have a good right to convey ____.  That the same is unencumbered.  We do further covenant and bind ourselves, our heirs & Representatives to warrant and forever defend the ___ to the said cotton crop and very part thereof to the said Benjamin P. Higgins, his heirs and assigns against the lawful claims of all person whatsover.  This bill of sale is made for the following use and trust and for no other purpose that is to say, that John Thornton and indebted to one Mrs. ____ Eddins in the sum of one hundred and ten dollars by note under seal of ___ date due the 25th of December 1854? when? note the said Benjamin P. Higgins is my security _______ and make certain the payment of the _______ pay this said debts by the 25th day of December _______(Can not read the remaining portion of the page, the following is assumed to be a part of the same document, but there is no way of telling if it is or not)  Court house door of Giles County and at the Election Ground of District No 1 of said County and three other  public places in the neighborhood my expose the said cotton crop to public sale and sell it to the highest bidder for cash, and appropriate the proceeds first to the payment of the necessary expenses and costs, secondly to the satisfaction of the above named debts of two hundred and ten dollars and damage and cost, thirdly to pay the balance if there be, to us, this 4th day of May 1855 given under our hand and seal.  Executed and delivered in our presence the day of May 1855.  (signed) John Thornton, Brackston Oneal (witness) B.J. Eddings & J.W. Scott state of Tennessee, Giles County.  Personally appeared before me, Edward D. Jones Clerk of the County Court of Giles County, B.J. Eddins and J. W. Scott subscribing witness to the within or foregoing deed who being first sworn depose and say, that they are acquainted with John Thornton and Brackston Oneal the bargainers and that they acknowledged the execution of the within or foregoing deed for the purposes therein contained -- witness my hand at office this 11th day of May A.D. 1855.

The state of Tennessee Vs Blackston O'Neal --Charge: Affray
This day came the Att. Gen. who presents, on behalf of the State Vs the deft. in proper person, being charged upon this bill pleas not guilty and for his trial puts himself upon the County and he ___ given oath the like.  Whereupon came a jury of good and lawful men to writ: Robert Drennon, A.W. Hardin, T. Kinncan, F.J. McConnell, P. R. Garner, H.E. Davis, A. Milstead, T. Gault, G.W. Jones, E. Straw, J. H. Gibson, & S. Buchanan, who being elected tried & sworn will & truly to try the issue joined upon their oaths, do say the deft. is no guilty as charged in the bill of this indictment.  Therefore is it order that the deft. be discharged and go hense without delay.
